Mercury -safe? Is the fish you are eating mercury safe? Maine DEP does NOT want you to know?

We are requesting expansion of Maine's safe eating guidelines for fresh water and salt water species to include Recirculating Aquaculture System (RAS)  salmon tankfarms  raised in waters with known mercury restrictions based on those guidelines.

Specifically the new label would be for Atlantic Salmon and other fishes raised in Recirculating Aquaculture System facilities , when the incoming habitat water for the tank-farmed salmon is taken from rivers and/or lakes with fish or seafood consumption warnings imposed by the state for pregnant and nursing women, women who may get pregnant, and children under the age of 8.

Or where wild harvest is  prohibited due to mercury concerns as in the case of Lower Penobscot River's lobster and crab fisheries.

We think that  DEP has erred by declining to  adopt  an incremental precautionary approach to the health safety impacts from the introduction of the new Recirculating Aquaculture into Maine's top wild salmon waters: Penobscot  River and Penobscot Bay. 

Expressing an inadequate “best professional judgement” that the fish grown in a lower Penobscot river-dependent RAS operation proposed for Bucksport probably would not violate state mercury safety standards.

Importantly, even then,  DEP is only referring to the discharge wastewater, not the content of the flesh of the fishes themselves.

Suspended mercury levels in these waters will  vary  as tanker ships, cruiseships  tugboats  and the annual snow melt  stir up  and re-elevate mercury-tainted  lower river sediments .  Whatever  systems the company proposes for mercury removal from incoming river and lake water must be able to adapt as the area's water concentrations of methylmercury  rise and fall.

Our concern is that,  despite their best efforts, the mercury concentrations in the RAS salmon fish tissues will fluctuate.  This would vary based on the location and seasonality of the salt wedge in the lower Penobscot River, where sediments can resuspend as currents collide at this fresh salt interface.

For that reason, we believe that  mercury advisory guidelines be developed.specifically for fishes raised in tanks whose waters are sourced in lower Penobscot River  and Hancock County lakes and ponds. 

The state  currently suggests that fish from waters of "Penobscot River below Lincoln" be limited to  "1-2 fish meals per month"

   While it may never need to be imposed, it is critical for the public health agencies have an advisory's language already drafted for this new class of salmon, that, unlike landlocked salmon and open ocean net pen salmon, must spend their entire lives bathing & breathing waters known to have elevated mercury levels. The potential for significant mercury uptake in RAS tank farmed salmon is real in our estimation.

It is prudent for the State of Maine to act NOW and preemptively develop a guideline mercury standard for the flesh of RAS fish raised entirely using state waters known to be contaminated by that metal. For RAS applicants the potential for label requirements will be a powerful incentive to those and future applicants to take this issue very seriously from the start.

The new advisory and label will be timely. This new system of fish farming in Maine is drawing many investors. Maine is touted by the seafood industry press and media as one of the most desirable states in which to operate these facilities. We have little doubt that Penobscot Bay and its tidal rivers will feature greatly in such initiatives,

It is imprudent to waiting until more of these facilities dot the shores of Maine rivers, bays and coasts, and the industry gets the clout to challenge creation of such standards.

Such an advisory label, clearly visible to potential buyers,would be used by: in three venues

* Wholesale distributors' invoices of product from a RAS facility with such water quality challenges.

* Retail and online outlets where said product is sold fresh, frozen or processed, 

* Advertisements and commercials promoting said product from that facility

 

At Issue: Unlike landlocked salmon, RAS farmed salmon are raised in both freshwater and saltwater tanks during different stages of their lives. When the freshwater for an RAS facility is drawn from a lake sufficiently contaminated with mercury to have an advisory for its fishes, and then the saltwater for that facility's fishes' post-smolt phase of their lives is drawn from a section of a river closed to crustacean harvesting due to mercury contamination, the farmed fish will have at least double the exposure to mercury.

Our mercury advisory request presently concerns the proposed use of Penobscot River water pumped ashore in Bucksport Maine to raise Atlantic salmon in a land based recirculating aquaculture  operation that would be joined by freshwater from a Bucksport Lake that also has a mercury advisory.

According to court ordered and peer reviewed studies, the high turbulence of river waters adjacent to the town of Bucksport resuspends more mercury into the water column there than anywhere else on the river.

Significantly, the level of mercury  in this reach of waters may be grossly underestimated, due to incomplete testing. After revealing very high levels of resuspended mercury, the sampling device used in the Penobscot River Mercury Study failed, preventing a fuller understanding of the mercury content of the Bucksport water column. ( (PMRS Ch7).

 

A  RAS facility that uses river and lake waters that are under mercury advisories may assert that certain filtering processes will remove a large percentage of  mercury from those waters before their seafood species are immersed in it. 

This is only a partial removal at best, and is yet to be proven for waters pumped continually into and through the facility at a very high rate and in such large amounts, as RAS facilities require,  with varying levels of mercury in them

At best the organisms raised in such waters their entire lives would have lower levels of mercury (but most certainly not mercury-free) 

 

At worst would have MEHG levels above the state's food safety advisory trigger. That they are raised in a concentrated area with little of the variability of wild fishes.

Moreover the aforenoted incomplete records of mercury contamination off Bucksport may skew the decision making on how much mercury must be removed to let the RAS facility's fish avoid labeling.

 

Until such time as a reliable study clarifies the amounts of mercury actually in Bucksport waters,  we request the department to be responsibly precautionary and require safe eating guidelines labeling of aquaculture products raised in waters that are under state and/or federal mercury advisories.    

 

In closing, we must again emphasize that as interest in siting RAS aquaculture facilities in Maine grows ,it is imperative that the state of Maine protect health of consumers of RAS aquaculture products raised with such waters, by requiring the appropriate health advisory labels to be affixed to the products  whether fresh, frozen or processed.

 

The advisory would warn pregnant and nursing women, women who may get pregnant, and children under age 8 not to consume  fishes from RAS facilities raising fishes using significantly mercury  contaminated waters, and for others to limit their consumption of salmon from such a facility to once per month.

 

SUGGESTION We would like to work with Maine CDC  and this new industry to ensure that our concerns are reviewed and that, as needed, the products of  land based recirculating aquaculture systems are listed appropriately in the state's  Safe Fish Eating Guidelines.

Penobscot Bay activists call for health advisory labeling of RAS salmon raised in mercury tainted waters.

BUCKSPORT. Plans to grow market Atlantic salmon raised  from egg to harvest solely in water from mercury-contaminated waterbodies have raised concerns in Maine over potential dietary health risks for children and pregnant or nursing women.

In response, environmental group Friends of Penobscot Bay (BLOG) has written to the Maine Centers for Disease Control asking the state to develop an advisory label for salmon raised in recirculating aquaculture systems that use mercury tainted waters. Read letter here       

A recent report found Bucksport to be one of the most mercury polluted river towns in Maine.   While the state has strict mercury advisories on nearly all  Maine freshwater fishes,  and such saltwater species as striped bass, shark and swordfish, not so for RAS-farmed salmon.

FOPB noted that in the case of at least one project underway in Maine Whole Oceans LLC, salmon would  be raised  from egg to harvest in giant tanks filled with water piped continuously from  mercury tainted lower Penobscot River.  Ron Huber the group's  executive director  said that  "because of the real potential for significant mercury uptake by RAS tank farmed salmon exposed to these waters, we are asking  Maine Centers  for Disease Control  to expand its public health protections   by developing a warning label for salmon raised in any water that is considered polluted based on the court ordered of the Penobscot River Mercury Study."

 FOPB river coordinator Adrienne Caldwell, of Bucksport, said, “unlike wild salmon and open ocean net-pen salmon, RAS fishes raised solely in facilities that use water from upper Penobscot Bay or the lower Penobscot River will spend their entire lives swimming in and breathing waters known to have elevated mercury levels." 

"Let's be precautionary" she said. "Whole Ocean's claim that Recirculating Aquaculture Systems reduce mercury concentrations isn't good enough."

 Huber summarized the Whole Oceans project as  "in the wrong place at the right time. Yes," he said, " Land-Based Recirculating \Aquaculture is a growth agribiz, but no, the mercury tainted Penobscot estuary is not the place for it to grow."
" I mean, really?" he added. " Pick the most mercury-fouled river in the United States as water supply for your salmon tank farm startups?  If consumers knew, he added "they would be reluctant to buy salmon from that company,

Caldwell wondered "What were they thinking?".

The Friends of Penobscot Bay will be hosting a number of educational field events in the mercury contaminated area.

SUMMARY 
Maine currently has mercury health advisories for  nearly all fishes captured in Maine lakes and ponds, for striped bass, shark and swordfish, and an outright ban on lobstering and crabbing in the lower Penobscot River, due to significant mercury pollution of the waters and sediments.

   Currently, commercial raised atlantic salmon are considered low in mercury. due to the natural flushing activation of the  bays where net pens salmon farms are operated .   Friends of Penobscot Bay's proposal would add an  special advisory for salmon grown in tanks filled with such mercury impacted waters.  The label would recommend zero consumption of such tank-raised fishes by children under eight, or pregnant or nursing mothers - the same as for other fishes living in those waters.

The advisory labels would be required for
* Wholesale salmon distributors' invoices from a RAS facility with such challenges,
* Retail & online outlets where said fish is sold fresh, frozen or processed,
* Advertisements and commercials promoting salmon from that facility.

Maine Legis' Environment and Natural Resources Comm gives ONTP to Pen Bay dredge sampling reform bill

LD 1287 An Act To Protect the Penobscot River and Penobscot Bay from Mercury Contamination  had its hearing  before the  state Legislature's Environment and Natural Resources  Committee on April 11th and its worksession April 17, 2019.

While supporters left the public hearing feeling they'd gotten some traction, six days later  the committee spent 21 minutes considering  LD 1287 and the testimony they'd received, and  a DEP official give a clarification before voting unanimously Ought Not To Pass, effectively killing the bill.  

A last minute flurry when a late arriving letter from the Penobscot Nation was read  silently by  the  Environment and Natural Resources  Committee chair, just before the ONTP vote.  The letter wasn't described audibly, but will shortly show up on the committee website

Attorney Tucker challenged the state's methodology in arriving at locations of higher or lower levels of mercury contamination in the sediments and lobsters of the lower river and upper bay.

She also presented DMR with copies of  a new DEP permit allowing the Mallinkrodt company (owner of the property that is the chief source  of mercury in the river and bay.

SEARSPORT — Final approval for a scrap metal storage operation at Mack Point was given May 11.
Planning Board members unanimously voted to approve the application by Grimmel Industries LLC following a brief public hearing, during which residents voiced concerns about mercury as well as air and water quality.
Grimmel submitted a letter to the Planning Board April 29 with documents requested by the board, including best management practices by Sprague Energy Corp., on whose property Grimmel will operate.
Attorney Brian Rayback, speaking on behalf of Grimmel, said the company chose to abide by tougher federal standards in regard to its SWIP, or Solid Waste Implementation Plan. He told board members the Department of Environmental Protection granted Grimmel its own stormwater permit.
“This approval only applies to the discharge of stormwater,” he said. “We are not seeking to discharge anything else into the water.”
Rayback said there was a discussion about metals dropping into the water and the company has designed new “curtains” to prevent transfer of metals from contaminating bodies of water. A magnet is also used to clean up the water in the case of any loose metal, which is valuable to the company, he said.
Residents wondered why the DEP did not have a public hearing before issuing Grimmel's permit; Rayback clarified a hearing is optional but the agency is always open to accepting comments on proposals.
“It's inherent in the nature of that that it's a quick turnaround time,” he said. “We worked closely with the DEP because we knew this would be under scrutiny.”
Resident Ann Crimaudo said she had a letter from the federal Environmental Protection Agency stating a hearing would certainly take place before a permit was issued. She said she understood the board could not do anything about the lack of a hearing but wanted the EPA letter included in the record.
Ron Huber of Rockland, executive director Friends of Penobscot Bay, encouraged the Planning Board to consider strict monitoring of the operation. Steve Tanguay shared his concern staffing levels at the local and state level are too low to adequately monitor contamination levels.
Rayback noted neither EPA nor DEP guidelines include monitoring for mercury levels, an area of concern repeatedly brought up by residents.
“EPA concluded that mercury is not a pollutant of concern in this application,” he said. “… It's a very difficult thing to monitor for and we agree. … The DEP general permit says you don't have to monitor for mercury or any other metals if you're a scrap metal dealer. … We are confident we can meet the standards.”
Rayback later said the company does not plan to monitor or test for mercury.
“If Grimmel isn't doing anything harmful, they don't have anything to worry about,” Selectman Meredith Ares said.
Rayback said he has little knowledge of the mercury testing process or its associated costs.
“It's not as simple as setting the baseline and imagining it as a constant level,” he said.
Sprague Environmental Compliance Manager Jason Littlefield said the EPA believes acid rain is to blame for random shifts in mercury levels.
“It takes years to come up with some sort of baseline,” he said. “ … It's a difficult pollutant to come up with a source.”
Rayback discouraged the board from attempting to create monitoring guidelines on its own.
“We don't have anything to hide; we don't think we are the source of it,” he said. “I'm worried about setting up a testing program that's scientifically defensible.”
While the application received conditional approval in February, the board voted again on the conditional items — unanimously agreeing the conditions had been met — and also, upon the advice of town attorney Bill Kelly, on the application as a whole.

Grimmel Industries' waterfront scrap metal junkard proposal - Peter Taber on why it's a terrible idea for Searsport.

When many older junked cars are shredded, hard-to-reach mercury switches including mercury switches used as part of brake anti-skid systems are frequently not removed even though this is in violation of state law and the U.S. Clean Water Act. These switches get torn apart in the shredder and their extremely toxic contents spattered freely about the scrap pile.

This accounts for most of the unacceptably high levels of inorganic mercury that for the past dozen years have been detected entering the Piscataqua River at Portsmouth, NH., near Grimmel Industries' waterfront scrap metal piles. This mercury is in addition to unacceptable levels of other scrap metal contaminants — among them polychlorinated biphenyls, aluminum, copper, iron, lead, and zinc — entering the waters of the United States in runoff from Grimmel Industries' Portsmouth operations.

On three occasions, the U.S. Environmental Protection Agency has gone after Grimmel Industries (pdf) imposing civil fines totaling over half a million dollars for repeated instances of toxic waste dumping and reporting violations. The behavior of owner Gary Grimmel of Topsham, Maine, in continuing these violations with an apparent sense of impunity suggests he made a cold-blooded cost-benefit analysis and concluded the EPA fines were merely an acceptable cost of doing business.

What Grimmel appears to have overlooked in making his calculations is that this sociopathic behavior would cause the City of Portsmouth and the Pease Development Authority to disinvite Grimmel Industries. With his lease expired at year's end and the welcome mat in Portsmouth rolled up, Gary Grimmel is looking to a new industrial waterfront community to bring his poisonous commodity. With foreign fossil energy company Sprague Energy as his eager new landlord, that community seems to be Searsport.

The question now is has Searsport's municipal leadership learned anything over the past 40 years from being suckered in by one addle-brained pitch for irresponsible heavy industry after another.

SEARSPORT — There was much discussion but little action on the part of Searsport Selectmen Dec. 16 as they addressed a junkyard application....

Grimmel Industries LLC, a scrap metal recycling company, submitted an application to open a junkyard on Mack Point, an industrial area of town. While selectmen ultimately decided to table the application, citing a need for additional information, there was some discussion.

“I want to do this right, especially since it's the first one,” Selectmen Chairman Aaron Fethke said.
Town Manager James Gillway said there are only a few criteria for selectmen to consider, including proper screening of the operations taking place on 2.5 acres. He said the application submitted by Grimmel states there will be no shredding of automobiles — a noise concern brought up by Selectman Jack Merrithew — and screening should not be an issue as the only abutter wants the business located there.

In its application, Grimmel described the operation as a marine transfer yard and estimated truck traffic to be limited to around 10 trucks, or four rail cars, per day.

Boston resident John Hassey suggested selectmen be wary and conduct due diligence prior to granting a junkyard permit to Grimmel. He noted there have been ongoing noise and environmental issues with the company's Portsmouth, N.H., location.
According to previously published reports, Pease Development Authority declined to renew a contract with Grimmel and requested the company cease operations and clean up its 3-acre site on Piscataqua River before the end of the year.
The development authority and Grimmel originally entered into a contract in Portsmouth in 2002. In 2011, the company was ordered by the Environmental Protection Agency to stop allowing runoff into the river.
According to EPA documents, “ … stormwater discharges from Grimmel's metal scrapyard operation contain metals, suspended solids and chemical oxygen demand which exceed permit benchmarks. Further the stormwater discharges contain mercury and PCBs …” The state of New Hampshire issued a warning to limit consumption of salt water fish as well as lobster, according to the EPA.

It is unclear when selectmen will next address the application.
