Maine's Land Based Aquaculture sent back to the sea. DMR pleased.

"For all at last returns to the sea -- to Oceanus, the ocean river..."  Rachel Carson was spot on, for that which was taken from DMR, hath  returned to DMR.

Keliher was followed by testimony from Friends of Penobscot Bay's exec director Ron Huber and by Bill Keleher, president & CEO of Kennebec Biosciences These were followed by vigorous committee questioning of Keliher. Then the worksession where the committee voted Ought to Pass unanimously

The committee held both the bill's public hearing and its work session, severing salmon tankfarm aquaculture licensing from the Dept of Agriculture Forestry and Conservation and restoring it to the Department of Marine Resources.
The bills' name is lengthy but clear:
Senator Dave Miramant
      Huber affirmed the Commissioner's reasoning and cautioned the committee against adopting an amendment put forward by Sebastian Belle of the Maine Aquaculture Association. The amendment would  establishing a tiering system for enforcement. He said it had no right being within this bill on transferring jurisdiction. 

And...with no partisans present for the amendment and studied disinterest in the amendment from the commissioner , legislative uneasiness  led to thumbs downing ehe MAA amendment. Sorry, Sebastian!

DSCF to DMR opponent Kennebec Biosciences opposed the transfer asserting the DACF had the capability restoration to DMR unnecessary.

BACKSTORY DMR had midwifed landbased Recirculating Aquaculture SDystems - time back, developed the basic rules and regs.Then Lepage moved the program to Dept Agriculture Conservation & Forestry which was given a bit of money to have someone keep it going. But this was JUST BEFORE Nordic and Whole Oceans began to work their applications.ACF was not prepared for the magnitude of the projects put forward by Nordic Aqua Farms and Whole Oceans LLC.

Poor salmon tankfarmers are probably wondering why they didn't invest in something more stable, like sandworm aquaculture.

Rockland City Councilors hear and discuss top harbor/waterfront issues commercial, residential and marina encroachment onpublic lands.


Listen below to Rockland City Council's agenda setting meeting's opponents and supporters of retail/residential redevelopment of marine industry zoned lands. And reaction to the city's announcement of a fresh plan for its municipal channel.
(1) Marine trades-zoned lands: What Jeff Hamilton, FMC/Dupont manager  said in oppo to plans by city proponents of would-be residential retail developers  They even considered 'taking'  Dupont's newly acquired land between Lermond Cove, Tillson Avenue, FMC/Dupont. to that end.

The department shall grant a permit upon proper application and upon such terms as it considers necessary to fulfill the purposes of this article. The department shall grant a permit when it finds that the applicant has demonstrated that the proposed activity meets the standards set forth in subsections 1 to 11, except that when an activity requires a permit only because it is located in, on or over a community public water system primary protection area the department shall issue a permit when it finds that the applicant has demonstrated that the proposed activity meets the standards set forth in subsections 2 and 5.

9. Dredging.  If the proposed activity involves dredging, dredge spoils disposal or transporting dredge spoils by water, the applicant must demonstrate that the transportation route minimizes adverse impacts on the fishing industry and that the disposal site is geologically suitable. 
The Commissioner of Marine Resources shall provide the department with an assessment of the impacts on the fishing industry of a proposed dredging operation in the coastal wetlands. 
The assessment must consider impacts to the area to be dredged and impacts to the fishing industry of a proposed route to transport dredge spoils to an ocean disposal site. 
The Commissioner of Marine Resources may hold a public hearing on the proposed dredging operation. In determining if a hearing is to be held, the Commissioner of Marine Resources shall consider the potential impacts of the proposed dredging operation on fishing in the area to be dredged. 
If a hearing is held, it must be within at least one of the municipalities in which the dredging operation would take place. If the Commissioner of Marine Resources determines that a hearing is not to be held, the Commissioner of Marine Resources must publish a notice of that determination in a newspaper of general circulation in the area proposed for the dredging operation. The notice must state that the Commissioner of Marine Resources will accept verbal and written comments in lieu of a public hearing. 
The notice must also state that if 5 or more persons request a public hearing within 30 days of the notice publication, the Commissioner of Marine Resources will hold a hearing. If 5 or more persons request a public hearing within 30 days of the notice publication, the Commissioner of Marine Resources must hold a hearing. In making its determination under this subsection, the department must take into consideration the assessment provided by the Commissioner of Marine Resources. The permit must require the applicant to:
A. Clearly mark or designate the dredging area, the spoils disposal route and the transportation route; [
B. Publish in a newspaper of general circulation in the area adjacent to the route the approved transportation route of the dredge spoils; and 
C. Publish in a newspaper of general circulation in the area adjacent to the route a procedure that the applicant will use to respond to inquiries regarding the loss of fishing gear during the dredging operation.

Commercial/ residential development plan withdrawn for contaminated lands on Tillson Avenue

A plan for commercial/residential  development of semi-remediated l contaminated lands  on Tillson Avenue in Rockland has been  dropped. This was followed by the land's acquisition by  the latest owners of the seaweed reduction plant that produces carrageenan and other marine colloids.

Maine legislature's ENR committee gives OTP to conflict of interest limits on Board of Environmental Protection members re air pollution applications

On May 2, 2019, Maine legislature's  Environmental and Natural Resources Committee held a public hearing and a work session   approving committee passage of  LD 1644  "An Act To Clarify Conflict of Interest Requirements for the Board of Environmental Protection"

The bill adds to reviewers of air pollution permit  applications  the same  restrictions that  deciders of water pollution permits  already have, about  conflicts of interest  ** Link to DEP Air Bureau
